1. Eligibility

You must be at least 18 years old and have the legal capacity to enter into a binding contract. By using the site you represent that you meet these requirements.

2. Products and Descriptions

All items sold are pre-owned or vintage. Condition, age-related wear, patina, minor marks, and hardware characteristics are inherent to the nature of the goods and are disclosed through photographs, measurements, and written descriptions to the best of our ability.

We authenticate every item before listing. Product descriptions and photos are part of the offer. You are responsible for reviewing all available information and asking questions before purchase. Colors may appear differently due to monitor settings and lighting.

Prices are listed in U.S. dollars and are subject to change without notice until an order is accepted. We reserve the right to correct pricing errors and to refuse or cancel any order.

3. Orders and Payment

Placing an order constitutes an offer to purchase. We may accept or decline any order at our sole discretion. Order confirmation does not guarantee acceptance if the item has already sold, is unavailable, or if fraud is suspected.

Payment is due at checkout through our designated processors. You authorize us (and our processors) to charge the payment method you provide. You are responsible for any applicable sales tax.

We reserve the right to cancel orders that appear fraudulent, violate these Terms, or cannot be fulfilled.

4. Shipping

All shipping terms are governed by our separate Shipping Policy, which is incorporated into these Terms by reference. Key points include: U.S. addresses only, free shipping within the United States, no P.O. Boxes or APO/FPO addresses, signature required on orders over $300, and carrier claims handled by us under the conditions stated in that policy.

Risk of loss transfers according to the Shipping Policy.

5. Returns and Refunds

All returns and refunds are governed by our separate Return Policy, which is incorporated into these Terms by reference. Returns are accepted only within the stated window, in the required condition, and with a Return Authorization. Buyer is responsible for return shipping costs, insurance, and risk of loss during return transit.

6. Intellectual Property – Strict Ownership and Enforcement

All content on this website, including but not limited to all product listing photographs, videos, images, product descriptions, text, graphics, logos, and design elements, is the exclusive intellectual property of Vintage Icon Vault and is protected by United States copyright law and other applicable intellectual property laws.

All listing photographs and videos are copyrighted by Vintage Icon Vault. We own the full copyright in every photograph and video we create and publish on this site.

You are expressly prohibited from copying, downloading, reproducing, distributing, displaying, publishing, modifying, creating derivative works from, scraping, framing, or otherwise using any of our photographs, videos, or other content in any manner whatsoever without our prior, explicit, written permission. This prohibition applies to use on any other website, marketplace, social media platform, advertisement, catalog, or any other medium, whether commercial or non-commercial.

Any unauthorized use of our photographs, videos, or other copyrighted content constitutes copyright infringement. We will take legal action against any party that uses our photographs or videos without our prior explicit written permission. This includes, without limitation, seeking injunctive relief, statutory damages, actual damages, profits attributable to the infringement, and recovery of our attorneys’ fees and costs to the fullest extent permitted by law under the U.S. Copyright Act and any other applicable law.

Permission, if granted, must be obtained in advance and in writing from us. No implied license or fair-use claim is granted by the mere viewing of content on this site.

We actively monitor for unauthorized use of our intellectual property and will enforce our rights vigorously.

7. Prohibited Conduct

You agree not to:

• Use the site for any illegal purpose
• Attempt to interfere with site security or functionality
• Scrape, harvest, or collect data from the site without authorization
• Misrepresent your identity or submit false information
• Engage in any activity that could damage our reputation or business
• Use, copy, or distribute any of our photographs or videos without prior explicit written permission

We may suspend or terminate access for any violation.

8. Disclaimer of Warranties

Except as expressly stated in these Terms or our Return Policy, all products are provided “as is” and “as available.” To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the site will be uninterrupted, error-free, or free of viruses.

9. Limitation of Liability

To the maximum extent permitted by law, Vintage Icon Vault and its owners, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising out of or related to your use of the site or any product purchased, even if advised of the possibility of such damages.

Our total liability for any claim arising out of these Terms or any product shall not exceed the amount you paid for the specific item giving rise to the claim.

Some jurisdictions do not allow certain limitations; in those cases the limitation will apply to the fullest extent permitted.

10. Indemnification

You agree to indemnify, defend, and hold harmless Vintage Icon Vault and its owners from and against any claims, damages, losses, costs, or expenses (including reasonable attorneys’ fees) arising out of your breach of these Terms, your misuse of the site, or your violation of any law or third-party right (including any unauthorized use of our intellectual property).

11. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Alabama, without regard to conflict-of-law principles.

Mandatory Binding Arbitration. Any dispute, claim, or controversy arising out of or relating to these Terms, your use of the site, or any product purchased from us shall be resolved exclusively by binding arbitration administered by the American Arbitration Association in accordance with its Commercial Arbitration Rules. The arbitration shall be conducted in Alabama. Judgment on the award may be entered in any court having jurisdiction.

You and Vintage Icon Vault each waive the right to a trial by jury and the right to participate in any class action, collective action, or class arbitration. The arbitrator may award individual relief only.

Limited Exception for Intellectual Property. Notwithstanding the foregoing, either party may seek temporary, preliminary, or permanent injunctive or other equitable relief in a court of competent jurisdiction solely to protect intellectual property rights (including copyright in our photographs and videos) or confidential information. This exception does not allow either party to seek monetary damages in court for those claims; monetary claims remain subject to arbitration.

Before initiating arbitration, the parties must first attempt to resolve the dispute informally by contacting us. If the dispute is not resolved within thirty (30) days, either party may commence arbitration.

12. Changes to These Terms

We may update these Terms at any time. The “Last Updated” date will reflect the most recent version. Continued use of the site after changes constitutes acceptance. Material changes will be noted on the site.

13. Miscellaneous

If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force. These Terms, together with the Privacy Policy, Shipping Policy, and Return Policy, constitute the entire agreement between you and us regarding the subject matter. Our failure to enforce any right does not waive that right.
